The Ministry of Oceans and Fisheries (MOF) in South Korea requires that all producers of animal products for human consumption, including products subject to quarantine upon import to South Korea, must be listed through the service unit National Fishery Products Quality Management Service (NFQS).

Listeføringen hos NFQS er uavhengig av listeføringen hos Ministry of Food and Drug Safety (MFDS). Mens listeføringen hos MFDS skjer via registrering hos Mattilsynet, vil eksportør sammen med importør være ansvarlig for listeføringen hos NFQS. 

Virksomheter som har hatt eksport til Sør-Korea før 4. juli 2024 trenger ikke å foreta seg noe for å bli listeført. NFQS vil i dette tilfellet selv hente opplysninger fra MFDS, som NFQS vil overføre til sitt register. 

Merk at for virksomheter som ikke har hatt eksport til Sør-Korea før 4. juli, vil det være nødvendig å aktivt registrere seg hos NFQS før eksport finner sted. Importørleddet i Sør-Korea er autorisert av NFQS til å gjennomføre registreringen på vegne av eksportør. Uavhengig av om eksport er planlagt, anbefaler Sjømatrådet at registreringen gjennomføres innen 31. desember 2024 slik at listeføringen er på plass for fremtidige eksporter.

Etter anmodning fra NFQS vil Mattilsynet oversende liste over alle norske virksomheter som har hatt eksport til Sør-Korea før 4. juli 2024. Bakgrunnen for anmodningen er at NFQS ønsker å kontrollere at opplysningene de henter hos MFDS er korrekt. Oversendelsen vil kun inkludere virksomhetsopplysninger om navn, reg.nr., kontaktperson, produkttype og virksomhetskategori. Informasjonen om virksomhetene vil være identiske med de som ble oversendt fra Mattilsynet til MFDS i oktober, og følgelig identiske med opplysningene som nå er publisert på nettsiden til MFDS. 

Oversendelsen fra Mattilsynet til NFQS er en engangshendelse. Dette innebærer at dersom virksomheten har gjort, eller planlegger endringer i sine virksomhetsopplysninger i listen hos MFDS i forbindelse med at ny liste oversendes fra Mattilsynet til MFDS i januar 2025, så må disse endringene i tillegg aktivt rapporteres inn til NFQS av eksportør/importør.

Vedlagt regelverk, Aquatic Organism Disease Control Act, indikerer hvilke opplysninger og dokumenter som kreves for å bli listeført hos NFQS.  

Når virksomheten er registrert hos NFQS vil registreringen være gyldig i 2 år fra dagen virksomheten ble registrert. Én uke før registreringen går ut kan virksomheten be NFQS om at registreringen forlenges. Prosedyren har til hensikt å fjerne virksomheter som ikke er aktive på Sør-Korea.

Registreringen hos NFQS gir NFQS hjemmel til å kunne gjennomføre inspeksjoner på listeførte virksomheter. Brudd på sørkoreansk importregelverk kan føre til at virksomheter blir suspendert fra å eksportere varer til Sør-Korea.

The listing with NFQS is independent of the listing with the Ministry of Food and Drug Safety (MFDS). While the listing with MFDS is done through registration with the Norwegian Food Safety Authority, the exporter, together with the importer, will be responsible for the listing with NFQS.

Companies that have exported to South Korea before July 4, 2024, do not need to take any action to be listed. In this case, NFQS will retrieve information from MFDS and transfer it to their register.

Note that for companies that have not exported to South Korea before July 4, it will be necessary to actively register with NFQS before export takes place. The importer in South Korea is authorized by NFQS to carry out the registration on behalf of the exporter. Regardless of whether export is planned, the Norwegian Seafood Council recommends that the registration be completed by December 31, 2024, so that the listing is in place for future exports.

Upon request from NFQS, the Norwegian Food Safety Authority will send a list of all Norwegian companies that have exported to South Korea before July 4, 2024. The background for the request is that NFQS wants to verify that the information they retrieve from MFDS is correct. The transmission will only include company information such as name, registration number, contact person, product type, and company category. The information about the companies will be identical to that sent from the Norwegian Food Safety Authority to MFDS in October and, consequently, identical to the information now published on the MFDS website.

The transmission from the Norwegian Food Safety Authority to NFQS is a one-time event. This means that if the company has made or plans to make changes to its company information in the list with MFDS in connection with the new list being sent from the Norwegian Food Safety Authority to MFDS in January 2025, these changes must also be actively reported to NFQS by the exporter/importer.

The attached regulation, Aquatic Organism Disease Control Act, indicates what information and documents are required to be listed with NFQS.

Once the company is registered with NFQS, the registration will be valid for 2 years from the day the company was registered. One week before the registration expires, the company can ask NFQS to extend the registration. The procedure is intended to remove companies that are not active in South Korea.

The registration with NFQS gives NFQS the authority to conduct inspections of listed companies. Violations of South Korean import regulations can result in companies being suspended from exporting goods to South Korea.
